Strict liability and absolute liability are some of the most fundamental concepts in the law of torts, and comprehension of their differences is critical for any law student. In this article, the sphere of tortious liability insofar as it relates to strict and absolute liability will be analysed, through the landmark cases of Rylands v. Fletcher and M.C. Mehta v. Union of India.
Liability
The concept of liability in torts is based on the fundamental principle that it is wrongful to cause harm to other persons, even if specific protections are absent. In law, a person is said to be legally liable when s/he is financially and legally responsible for something – an outcome that has transpired due to the person’s action or omission. This cause-effect relationship is crucial for establishing liability, for without a cause or source for the wrong, responsibility in general cannot be affixed – the element of ‘fault’ is required to impute harm and claim remedy.
Strict LiabilityRule Of Law
In the curious case of strict liability, the aforementioned concept of ‘fault’ is absent, along with intention and motive. This is because there are many activities which are so dangerous that they constitute risks to persons and property, and responsibility must be borne by some person in case of any harm. The law allows the potentially harmful activities to be carried on for the sake of social utility, but only in accordance with safety measures and the doctrine of strict liability – called so because the liability arises even without any negligence on the part of the defendant.
The Rule in Rylands v. Fletcher[1] :
The rule in this case rests on the idea of foreseeability­ of damage; the person who is the source of damage is penalized for failing to avert the reasonably foreseeable damage.
Facts: Rylands and Fletcher were neighbours. Fletcher owned a mill, for the energy purposes of which he hired independent contractors and engineers to construct a water reservoir on his land. It so happened that there were old unused shafts under the site of the reservoir which the engineers failed to notice and block. Due to the negligence of the contractors, when water filled Fletcher’s reservoir, the water entered Rylands’ coal mine and caused huge loss, for that is where the shafts led. Subsequently, Ryland filed a suit against Fletcher. The defendant claimed that it was the fault of the contractors’, and the cause of damage was unknown to him.
Issues: The issue was very concise – Can the defendant be held liable, even if it was the act of someone else due to which an entity on his land escaped? It was notable because there was no negligence or intention on part of the defendant.
Judgment: The House of Lords rejected the plea of the defendant and held him liable for all the damages to Rylands’ mine. According to the rule set by this case, if a person brings on his land and keeps there any dangerous thing, a thing which is likely to do mischief if it escapes, he will be prima facie answerable to the damage caused by its escape even though he had not been negligent in keeping it there. Despite there being no fault or negligence on the part of the defendant, he was held liable because he kept some dangerous thing on his land and the said dangerous thing has escaped from his land and caused damage.
Essentials of Strict Liability
Certain qualifications were given to decide whether a liability is strict liability or not. Only after these essential qualifications are satisfied, can a liability can be termed as strict liability. These essentials, which are elucidated upon further on, are:
*Some dangerous thing must have been brought by a person on his land.
*The thing thus brought or kept by a person on his land must escape.
*It must be non-natural use of land.
* Dangerous Thing
This simply means that the defendant will be liable when the thing that escaped from his premises was a dangerous thing. The word ‘dangerous’ here implies that it is likely to do any sort of mischief if it escapes from the land. The collected water in Fletcher’s reservoir was the dangerous thing in the above mentioned case.
*Escape
It is also essential that the thing causing harm must escape from the premises of the defendant, and it should not be within the reach of the defendant once it escapes.
*Non-Natural Use Of Land
For the use to be non-natural, it must be some special use that brings with it increased danger to others. It must not be the ordinary use of land or use as is proper for the general benefit of community.
The Exceptions
There are certain exceptions to this rule, which are:
*Default of the Claimant
If the damage is caused solely by the act or default of the claimant himself, there is no remedy for him.
*Consent of the claimant
Where the claimant has expressly or implicitly consented to the presence of the source of danger and there has been no negligence on the part of the defendant, the defendant is not liable.
*Act of God
An event which directly and exclusively results from natural causes that could not have been prevented by the exercise of foresight or by the exercise of caution may be called an Act of God. Say, if the escape was unforeseen and without any human intervention, caused by some super natural force, then the defendant will not be liable.
*Statutory Authority
An act done under the authority of a statute exempts the defendant from tortious liability. However, the defence cannot be pleaded if the if there is any kind of negligence on the part of the defendant.
*Act of Third Party
The rule of strict liability doesn’t apply when the damages are caused due to the act of a stranger, i.e. a person who is not the servant nor is under the control of the defendant. However, due care must be taken by the defendant to avoid the damages if the act of the stranger can be foreseen by the defendant.
Absolute Liability
Simply put, absolute liability is the application of strict liability, but without the exceptions.
The rule of absolute liability was evolved in the case of M.C. Mehta v. Union of India[2], and took strict liability one step further by stating that an enterprise which is engaged in a hazardous or inherently dangerous activity is absolutely liable for the harm resulting from the operation of such activity, and to compensate to all those who are affected by the accident.
Facts: On the 4th and the 6th of December, 1985 in Delhi, there was severe leakage of oleum gas which this took place in one of the units of Shriram Foods and Fertilizers Industries, which belonged to the Delhi Cloth Mills Ltd. Due to this, an advocate practicing in the Tis Hazari Court had died and many others were affected by the same. A writ petition by way of public interest litigation (PIL) was brought to the court.
Issue:. It was contested that if all the tragedies arising from the conduct of the large factories follow the rule of strict liability, they will fall under the exceptions and get away scot free for the damage they have caused in the conduct of their activity.
Judgment: The Court had noted that this was the second case of large-scale leakage of a deadly gas in India within the period of a year in India, as a year earlier more than 3000 people had died due to the leakage of gas from the Union Carbide plant in Bhopal and lakhs of others were subjected to various other kinds of diseases. If the rule of strict liability laid down in Rylands v. Fletcher was applied to such situations, then those who had established “hazardous and inherently dangerous” industries in and around thickly populated areas could escape the liability for the havoc caused thereby by pleading some exception. The Supreme Court therefore evolved a new rule – the rule of “Absolute Liability”, as coined by the then Chief Justice of India PN Bhagwati.
It expressly declared that the new rule was not subject to any of the exceptions under the rule in Rylands v. Fletcher. The Court gave two reasons justifying the rule:
*The enterprise carrying on such hazardous and inherently dangerous activity for private profit has a social obligation to compensate those suffering therefrom, and it should absorb such loss as overhead; and
*The enterprise alone has the resource to discover and guard against such hazards and dangers.
The Court explained its position in the following words: “If the enterprise is permitted to carry on any hazardous or inherently dangerous activity for its profit, the law must presume that such permission is conditional on the enterprise absorbing the cost of any accident arising on account of such hazardous or inherently dangerous activity as an appropriate item of its overheads. This principle is also sustainable on the ground that the enterprise also has the resource to discover and guard against hazards or dangers and to provide warning against potential hazard.”
The Court also laid down that the measure of compensation payable, that it should be correlated to the capacity of the enterprise, so that it can have the deterrent effect and the larger and more prosperous enterprises providing a greater amount of compensation for the damages they have caused.

The difference between Strict and Absolute liability was clearly mentioned by the Supreme Court in M.C.Mehta v. Union of India, where the court summarised it broadly as follows:
*In Absolute Liability only those enterprises shall be held liable which are involved in hazardous or inherently dangerous activities.
*The escape of a dangerous thing from one’s own land is not necessary. Absolute liability is applicable to those injured within the premise and outside the premise.
*The rule of Absolute liability does not have any exceptions, unlike the rule of Strict Liability.
*The rule elucidated upon in Ryland v. Fletcher applies only to the non-natural use of land, but absolute liability applies even to the natural use of land. If a person uses a dangerous substance and if such substance escapes, he shall be held liable even though he have taken proper care.
*The extent of damages depends on the magnitude and financial capability of the institute. The Supreme Court also stated that the enterprise must be held to be under an “obligation to ensure that the hazardous or inherently dangerous activities in which it is engaged must be conducted with the highest standards of safety and security and if any harm results on account of such negligent activity, the enterprise/institute must be held absolutely liable to compensate. for any damage caused and no opportunity is to given to answer to the enterprise to say that it had taken all reasonable care and that the harm caused without any negligence on his part”.

Are you new to Crusader Kings 2 and don’t know where to start? You probably encountred the tip to start from Ireland for the begging but the game is still slow and/or confusing? Fear not for this guide will show you how to create a kingdom in one character!Chapter 0: Before We Start
Before we start let’s clear something out that can be confusing for new players:
Cassus Beli is a reason for war. Without it you can’t fight. You can wage war against someone who has lands you or one of your courtiers have claim on and few other reasons, but for the sake of this guide we will need just Claim and De jure.
De jure means “by law”. Every duchy consists of counties, every kingdom is made of duchies and so on. If you have duchy title, but not all of it’s de jure lands belong in your realm, you can wage war against outside holders. Winning De jure war always results in realm coming to your realm (but if you are the king it’s not always for you, I will describe it later).
Claim is “legal” right for the land. Legal is in quotation marks since they can be fabricated (important!). Pressing a claim means wage a war in a name of person having the claim agains person holding the title. Winning the war not always result in land coming to your realm! If you are not claimant there are two conditions that must be met to get a land through Claim war:
*Claimant must already have land in your land (barony will suffice).
*The title you are pressing claim on must be lower than yours.
For example, if ou are a duke and you press claim on a duchy for someone else, that person will be independant. But if you are king and press a claim on duchy for your vassal duke, then duke will have two duchies and you still are his liege.
That should be enough to get you starting.Chapter 1: Starting Up
Step 1: Choosing your character.
For begginers, Ireland with a starting date of 1066 is a good choice for couple of reasons. Most rulers are count-tier which means they have up to 3 counties which is low. That gives you early advantage since you can easly gain more lands and be the most powerful person in the land.
Easiest characters are:
*Murchad ua Brian, duke of Munster – he is a duke with a single county, two vassals, a De jure claim on a nerby county, male heir and, what’s most important, a historical bloodline. That bloodline can be passed to his descendants which give ua Brians an advantage over other Irish rulers.
*Aed ua Conchobair, duke of Connacht – an old guy with realm of two is weaker than Murchad, but still relevant since he is duke, but he lacks the bloodline and lands. His advantage lies in his position. West Connacht has a double battle modifer giving your troops advantage and giving enemies disadvantage at the same time (attacking from here gives our troops disadvantage though).
*Murchad ua Cheinnselaig, count of Dublin – his start is a little bit trickier than the last two since he is a count and has no de jure claims. But he has two things other counts hasn’t at that is county of Dublin which is both duchy and kingdom de jure capital (it gives nice modifier to troops) and is an heir for county of Leinster, which makes him triple count. His dad has to die first though, by natural means, or your scheming. He is old, so you can just wait up.
For the sake of simplicity, the rest of the guide will be made as if ua Brian was chosen to play.
Step 2: Council. First thing you do is checking your council.
* Set your chancellor to Fabricate claim job on whatever county near you, but in case of Desmond it’s not needed(you already have De jure claim on it so it ‘s not neccesary, but if you fabricate claim you prevent a civil war, more on it later).
* Set your marshal to train troops in your capital
* Set your steward to collect taxes in your capital
* Set your spymaster to Study technology in another country (if you are ua Cheinnselaig and are plotting to kill your father set him to Build Spy network in Leincester)
* Set your chaplain to improve religous relation with any of your bishops.
If any of your council members has their stats below 15 here is a quick way to change it:
Go to Find character.
Set join court on yes and search all (remember that only men can be in council, exception is rulers wife who can be spymaster).
Filter them by what ability you need and invite those with best. Profit!
Having done that let’s go to the next step, which is…
Step 3: Stabilizing your realm using a civil war.
Yes you read that right. You are going to cause a civil war to get the counties your vassals have. We are doing it because if you control the county, you get all the troops, if it’s your vassal, it’s 40% at best. How do you do that though? There are 2 ways: the way of tyrant and the way of intrigue.
The way of tyrant is simpler one, but crippling your opinion. Just revoke the titles one by one and crush them. Be careful though, this impose tyranny (-40 opinion, ouch).
The way of intrigue takes longer but doesn’t impose tyranny:
*Go to intrigue (F7).
*In My Plots you have a table, click on the blue “Choose a plot”.
*Choose “Revoke county of …”
To succeed you need 80% plot power and at least 1 backer (that’s why your chaplain works on improving relations). If you meet the requirements, there is decision to revoke the county. By revoking them in this way vassals usualy rebel, which means you have to apply good old way of crushing them to bits. You should have more troops from your one county and vassal so it’s no worry.
When you hold all counties in your realm you can get to next chapter.Chapter 2: Conquest and Creating the Kingdom
So you have your realm stabilized. Good. Next step after winning the civil wars is more wars.
Step 0: Press your de jure claim on any counties that are outside of your realm and proceed to do with them what you did in chapter 2. If you are over your demense limit, raise the centralization law
Step 1: Fabricate Claim.
This is the reason most people don’t play as Ireland when they learn to play. Other countries can gain lands by pressing other claims, but Irish usually have to do without it at the beginning, which is bit tedious.
If you managed to fabricate the claim, just press it and win war and proceed to next step.
Step 2: Foregin Climants.
If you didn’t or you don’t want to wait for Fabricate to work then find a county you want to conquer. Click on it’s shiled and it will take you to the realm page. There is a button named “Claimants”. If it’s grey then though luck, try elswehere. If it’s blue, then let’s get to party. Clicking the button shows you the list containing all people with claims to that realm. If beside their portrait is green thumb up, then you hit a jackpot and can invite him to court. You can now press his claim in war, BUT DON’T DO THAT YET! If he doesn’t have land in your realm, he will just become new independent ruler, so first you have to give him something (even a barony will suffice). Then press the claim and win the war. If you are short on counties to give (leave at least as much as your most powerful vassal have to yourself), then just chapter 2 someone. Repeat this step until you have 10 counties in your realm, and then…

NFG loves fonts. It’s a sad little addiction that brought him to this: a page that allows you to create your own images, with words of your choosing, using fonts unceremoniously ripped from beloved arcade games of yore. Ultimate SoundFont Pack is a giant arsenal of SoundFont instruments useful for all producers. With a pack this heavy, they will cover pretty much any flavor of music production from trap to jazz and everything in between. For a while now I have been looking for rock guitar soundfonts. However, I found the supply rather lacking. Thus, I decided to make my own. The result was the Metal Guitar Soundfont Collection. The set consists of 3 soundfonts: Powerchords(muted and open. I own an Edirol SD-90 Studio Canvas, one of the synthesizers used by ZUN (in particular, the real source of his idiosyncratic trumpets).

I use Noteworthy Composer to create MIDI files, which I then send through SynthFont to create the actual sound-files, using various soundfonts I found on the internet. With the SD-90, I set it as the Playback Device in Noteworthy Composer, then record it using Audacity with the SD-90 set as the recording device. (If you want to use SynthFont and an external device like the SD-90, it’s a good idea to have some way of synchronizing things; I do it by having Noteworthy Composer play a single note several measures before the beginning of the music, recording that along with everything else, and then aligning them together in Audacity.)Miscellaneous
*The Bibliophile with the Enciphered Eye (SoundCloud) - I don’t really have any specific inspirations for the structure, other than just the original and just ’rocking out really hard’; I guess there’s bits of ’Pure Furies’ from Legacy of Lunatic Kingdom and some ’Last Occultism’ from Urban Legend in Limbo? Eh, it works on its own terms as much as anything else, I guess.
*Eyes Undeciphered (SoundCloud) - A ’final stage theme’ for Kosuzu. Basically: this follows the pattern in Double-Dealing Character and Legacy of Lunatic Kingdom for ’the final stage boss is an arrange of a subset of the boss theme’; I wished there were more than two examples so I could suss out a good pattern, but this is fine. This particular track probably wouldn’t actually exist in a Touhou game insofar as the two-minute loop portion is more than twice as long as most final-stage themes (i.e. Mountain of Faith’s is only 55 seconds), but I figure, sounding good was more important than mimesis, so here you go.

My original idea involved bits of EoSD’s extra stage theme, but this version it’s basically just ’The Far Side of the Moon: Charming Domination remix’ with a guest appearance by Great-Auntie Sumireko at one point. (For the record, I’m thinking Renko’s actual boss music would just be ’Greenwich In The Sky.’) I briefly considered doing a thing where it ends like an actual song like the original Far Side of the Moon, but at that point I’d already recorded it as ’intro with loop-points,’ oh well ...
*Kirby Dark Super Star - I was just really dissatisfied by the loop of the Dark Star theme from Kirby 64 ... so I basically just snuck in a bit from the ’Taking Over the Halberd’ song from Kirby Super Star.
*Megalofantasia (WIP #1) - A ’Touhou version of Megalovania’ (a song which has been used, in various forms, in Homestuck, Undertale, and the ’Earthbound Halloween Hack’), using bits of Necrofantasia. When you think about it, the one person who poses the greatest existential danger to Gensokyo is in fact Reimu. Fortunately, the reasons for this are linked inextricably to the reasons she will never voluntarily pose this sort of danger. That said, if she did go on a ’No Mercy run’, there’s no way Yukari’s not gonna be the one to be the final boss and knock some sense into her.

*Rin Satsuki’s theme. I decided that since Rin is still ZUN’s creation, I should use music created by ZUN himself, so after much deliberation, I chose this from Ghostly Field Club. The version I created doesn’t actually sound much like one of Twilight Frontier’s remixes, and I would’ve liked to use some of the same effects ZUN uses in the original, but I’m really limited here, I guess. ZUN’s comments said that it was meant to be about Maribel, so that works out too, to a certain extent.
*空隙少女 (Aperture Girl) [original]
*Final Story Mode pre-battle theme. I’m rather pleased both with how it managed to convey the epic confrontation, and how it’s also something that would almost fit in one of Twilight Frontier’s fighting games. If you can imagine this as an unused track from Touhou Hisoutensoku, if Touhou Hisoutensoku’s music was composed by a penniless American goofball with a soundfont that uses a few of the instruments ZUN uses, my work here is done. Actually, it’s inspired by Suika and Tenshi’s respective pre-battle themes from IaMP and SWR; still original, but made from ’real parts.’
*時空の縁辺　～ Navy-Blue Generation (Edge of Spacetime ~ Navy-Blue Generation) [original, Touhou Hisoutensoku]
*Meimu’s final battle theme. It didn’t end up sounding like I’d planned (though it would’ve helped if I’d actually had a plan at the start); it kind of sounds more like one it’s from one of the danmaku games than one of the fighting games. Opens with ’Unfound X ~ Unknown Adventure’ from Th12.3, the main theme has instrumentation meant to resemble Tenshi’s theme from SWR, and the rest is original.

*Yasora Kojiwa’s ’awakening’ theme (duh). I just wanted to combine Utsuho’s theme with the bit from Umbral Ultimatum at the end where Jack manifests himself. And then I put part of Yasora’s theme in the middle there. The goal was to convey, ’THIS IS A MOMENT OF AWESOME.’ Also worth noting: this was made entirely from beginning to end over the course of a several hours on the same day it appeared in-comic.

*Yasora Kojiwa’s theme. This tune’s story began when I was playing the Overlord expansion pack ’Raising Hell,’ and I misheard the final boss’s theme, and then decided to splice it together with genes from Utsuho’s theme. The former was the basis for the second section through the guitar-centric section right before the loop-ending bit that was taken directly from Nuclear Fusion. (I need some method of playing it in an actual proper looping fashion ...)
*魔女達の舞踏会　～ Sepiechritude (Witch’s Ball ~ Sepiechritude) [/Persona 3]
*I actually didn’t use any part of the Sepulchritude theme for this. Instead, I combined ’Witch’s Ball ~ Magus’ from Shuusou Gyoku (in which Marisa is the first EX-boss, and has angel wings ... but only one pair) with ’Burn My Dread -Last Battle-’ from Persona 3. This was originally made for SynthFont and the various shenanigans thereof, but it ended up being the first song I created that used the SD-90.
*How Does Shanghai Live [Con Air/Homestuck, sort of]
*So, this snippet is basically a remix of ’How Do I Live’ from Homestuck, which in turn is a remix of the song of the same name performed by Trisha Yearwood as seen in Con Air, except abruptly interrupted less than fifteen seconds in by a CODEC sound from Metal Gear Solid. This is basically exactly how Shenanigans in a Magical Forest has always been going to end. ... yeah, I’m never going to do a full rendition.

*Masha Kinoko’s theme. This was very deliberately not a battle theme; Masha, as she exists on the day of her birth, is simply not a fighter at heart. Except that it also uses a speeded-up version of the drumbeats from That One Segment from Radiocative, which were inspired by the drumbeats from Upward Movement (Dave Owns) which show up in half of the goddamn Homestuck flashes.

*The intro theme for Chapter 2. I thought ’Okay, what’s something Marisa-ish that I could do here?’ ... and then I thought that ’Magus Night’ would work quite well.

*Honeywell Planeview Manual 2017Flight management systems have never been considered simple pieces of equipment, but the technology is quickly evolving beyond basic navigation and performance functionality to include a host of new capabilities that hold the promise of changing the way pilots fly for the better.
Absent from some of the latest integrated avionics systems are the bezel-mounted control display units (CDU) flight crews have known since the 1970s. Instead, many modern business jets and some of the latest airliners are integrating FMS controls with the flight displays and cursor control devices (CCD), allowing pilots to point and click their way through a variety of menus or drag and drop any portion of their flight route (a technique known as “rubber-banding”) to include or modify a waypoint. The changes are resulting in cockpits that are more intuitive than those of the past–and even those of the present, in many cases–while packing more capability than ever before.
At the same time, hardware and software upgrades available from FMS manufacturers are opening the possibilities for complex, curved RNP (required navigation performance) procedures and the latest WAAS LPV (lateral precision with vertical guidance) approaches. The changes expand the operational capabilities of properly equipped airplanes today while serving as a cornerstone for future operations in so-called NextGen airspace.
“Integration of flight management systems with the displays is absolutely the trend that will continue to evolve into the future,” said Chad Cundiff, vice president of crew interface products for Honeywell. “There are just so many more possibilities when you start presenting flight-planning data graphically.” Pilots seated downwind of the latest and greatest integrated flight decks can rubber-band a flight plan line using the CCD, interrogate a waypoint on the screen and then click on the waypoint to pull up a list of likely actions from ATC, such as go direct, hold, intercept and so on.
Honeywell has already implemented these concepts in iNav, the flight-planning interface in the Dassault EASy and Gulfstream PlaneView cockpits based on the Primus Epic avionics system. In the Dassault cockpit the CCD is a large track ball mounted on the center pedestal, while in the large-cabin Gulfstreams pilots manipulate the cursor using switches on each sidewall. In both cases the result is the same: a crew interface that is more reminiscent of a Windows or Mac operating system than the traditional hunt-and-peck sequences that are required with a stand-alone FMS.
Many pilots flying business jets with graphical flight-planning interfaces, in fact, liken the difference between old and new to the change that occurred when PC users went from DOS to Windows. Going back to an airplane with standard FMS equipment after flying with the Primus Epic-based system and the latest iterations of the Rockwell Collins Pro Line 21 avionics system requires a period of “re-education,” pilots say. The number of available menu pages in a stand-alone Collins FMS, for example, is 86 compared with just 11 using Pro Line 21’s graphical FMS interface.
Research has shown that pilots training to use traditional FMS equipment retain only about 80 percent of what they’ve been taught in the classroom. They know what they need for everyday operation of the airplane, but things get murky when it comes time to dig deeper into FMS functionality.
Honeywell polled Dassault EASy and Gulfstream PlaneView pilots as they completed their initial training to determine whether the new graphical tools are indeed as easy to master as the designers had hoped. While Gulfstream retained the CDU and flight guidance control panels in PlaneView, Dassault threw its pilots straight into the deep end of the pool by requiring them to use the EASy trackball on every flight. When asked, pilots of both cockpits overwhelmingly said the new operating tools represented a “significant improvement” to a “real breakthrough.” Honeywell went back and talked with pilots who had been flying with EASy and PlaneView for many months or even years and found that they still remembered all the techniques they’d been taught in initial and recurrent and continued to use them once they got back home.
It was another story for pilots who flew exclusively with EASy or PlaneView for an extended period of time and then had to transition back to a cockpit fitted only with traditional FMS units. “The interesting thing we found is that those who stayed with the graphical tools for a few years and then tried to go back to the traditional CDU needed a little bit of help remembering all those keyboard commands they used to use,” Cundiff said. “That confirmed for us that the future is going to continue to focus on expanding the use of these graphical tools.”
Future capabilities that could benefit from a graphical interface include advanced traffic separation and in-trail procedures and dynamic routing around weather. Honeywell is working on software upgrades for Primus Epic, and Rockwell Collins has introduced a new cockpit called Pro Line Fusion that will take the graphical concepts to a new level, designers say. For pilots flying with Pro Line Fusion avionics in the Cessna Citation Columbus, Embraer Legacy 450 and 500, Gulfstream G250, Learjet 85 and Bombardier Global series, FMS CDUs will become far less important. “The graphical flight-planning tools we are integrating with Pro Line Fusion will greatly simplify the pilots’ job,” said Tim Rayl, senior director of advanced products at Rockwell Collins. “It’s a whole new way of flying and managing information.”
The trend toward using graphical flight planning techniques began with business jets a decade ago, but since then the tools have migrated down into light general aviation airplanes equipped with Garmin’s G1000, Avidyne’s Entegra and Honeywell’s Apex glass cockpits and up market into the latest airliners, namely the Airbus A380 and Boeing 787. Even long-time makers of traditional FMS equipment such as Universal Avionics and CMC Electronics are exploring ways to enhance their products by applying graphical user tools.
At its heart the core navigational side of the flight management system is composed of three functional pieces: a database, a processor and a user interface. Designers of next-generation integrated avionics systems such as Pro Line Fusion and CMC Electronics’ FronTier cockpits are aiming to reach even higher levels of efficiency and simplicity through greater use of graphical interfaces. Both of these avionics systems aim to define a new generation of cockpit that will add more flight management tools and closer integration of onboard systems.
The goal of Pro Line Fusion designers is to develop an architecture where flight plans can be easily created and modified using an integrated control display unit featuring an entirely new FMS user interface that organizes data by phases of flight. This, they say, will further reduce the number of CDU pages with which the pilots interact and provide a more intuitive overall user interface. Through the use of interactive map symbols, for example, pilots flying with Pro Line Fusion will be able to point and click on the displays and move seamlessly from one display to the next, calling up interactive dialog boxes and text windows aimed at optimizing data presentation and flow.
The WAAS Revolution

Professional pilots of all stripes will continue flying with traditional FMS equipment for years to come, mainly because so many airplanes in operation are equipped with the stand-alone units and many more are still rolling out of the factory with the units installed. Airlines will be especially slow to adopt the new technologies, but even in business aviation graphical interfaces and CCDs will probably remain out of the mainstream for many more years to come. But big changes are coming for traditional FMS products as well.
Universal Avionics has been at the forefront of the efforts to bring WAAS capabilities to the FMS. In the last year-and-a-half the Tucson, Ariz. avionics maker has added to a steadily growing list of WAAS LPV approvals, starting with the Challenger 601 and progressing through a variety of models from King Airs to Falcon 20s to the Boeing 727. Approximately 75 operators are currently flying WAAS LPV (lateral precision with vertical guidance) approaches using the Universal FMS family. The FAA’s recent announcement that WAAS LPV approaches now outnumber ILS procedures in the U.S. has boosted the interest level in the satnav operations, leading to a rush among FMS makers to add the capability.
Two “first of type” STCs were recently issued to West Star Aviation for Universal’s UNS-1Lw FMS with LP/LPV monitor in the Cessna Citation Bravo and V series airplanes, the avionics maker said last month. Marking the first approval of Universal’s WAAS-capable FMS for these aircraft types, the certification opens the door for any other Cessna 550 and 560 operator to add WAAS capabilities to its aircraft. West Star’s STCs included approval for 3-D coupled WAAS GPS (Rnav) LPV procedures.
Interest among helicopter operators in WAAS LPV approach capabilities has picked up in recent months as well, said Jason Mason, a senior marketing engineer at Universal Avionics. Certification programs for the Sikorsky S-76, S-92 and other helicopters are under way, he said.
The new WAAS-based approach types, coded as Rnav (GPS) LPV on approach charts, are by far the fastest growing GPS approach type in the U.S. As part of its NextGen national airspace system improvement plan, the FAA is focused on reducing operators’ dependence on older ground-based navaids such as ILS and VOR, and increasing the use of WAAS GPS navigation. Because of its ability to alleviate airspace congestion, save fuel and improve safety, satellite navigation technology is being applied worldwide, with systems in Europe and Japan planned to be operational soon.
Operators of aircraft equipped with satnav-enabled avionics can take advantage of lower descent minimums at more airports and improved performance and safety in bad weather. The WAAS-capable FMSs allow pilots to fly to ILS-like minimums (as low as 200 feet) at airports without an ILS approach with RNP-like accuracy of 0.3 nm without special operational approval from the FAA, as is required for RNP SAAAR (special aircraft and aircrew authorization required) procedures.
A number of WAAS LPV equipment approvals for business jets have been completed recently or will be finished soon as avionics manufacturers, installation centers and operators get serious about gaining the needed certifications to fly the GPS-based procedures. Rockwell Collins last year secured approval for the WAAS LPV upgrade in the Challenger 604 as part of a contract with the FAA’s Aviation Systems Standard Division. The certification clears a path for all Challenger 604 operators to upgrade to a new LPV-capable FMS from Collins. Universal Avionics, meanwhile, announced certification for its UNS-1Fw WAAS LPV-compatible FMS in the Learjet 60 in a joint effort with STC holder Haggan Aviation of Englewood, Colo.
Duncan Aviation in Lincoln, Neb., has announced plans to certify LPV in a variety of business jets, including two Learjet 45s carrying the Universal UNS-1Ew FMS; two Gulfstream G100s, also with the UNS-1Ew FMS; a Cessna Citation Ultra with a single UNS-1Espw FMS; and a Falcon 900 with Honeywell’s NZ-2000 FMS upgraded with Version 6.1 software. While WAAS LPV approaches use GPS to provide landing minimums similar to those of ILS, upgrading Part 25 airplanes to the satnav capability requires an STC plus the installation of WAAS-compatible GPS receivers and in many cases additional cockpit annunciators.
RNP Coming to an Airport Near You

Required navigation performance will be a key element of NextGen airspace. The benefit of a so-called RNP SAAAR approach is that it can carve out a highly precise, curved path through the sky that usually results in lower landing minimums–sometimes much lower. But gaining approval is a costly and complex endeavor requiring submittal of monthly operational reports to the FAA, pilot simulator training and operations manual revisions. Considering that fewer than 100 RNP SAAAR approaches have been published so far, most operators probably won’t go to the trouble of gaining approval until their home airport has an RNP approach. But as more RNP procedures are created, operators who forego such approvals will be at a disadvantage compared with those who are SAAAR compliant.
To assist operators seeking to upgrade to RNP capability, Honeywell has launched Go Direct, a consulting service designed to help business jet operators take advantage of new RNP SAAAR procedures the FAA is adding at scores of airports around the U.S. The agency plans to publish 60 new RNP SAAAR procedures per year for the next two years. Some airports scheduled to receive an RNP approach in the next 12 months include Teterboro, N.J.; Aspen and Eagle, Colo.; Monterey, Calif.; and Scottsdale, Ariz. If your home airport or an airport you use often offers an RNP SAAAR approach, the approval can mean the difference between landing or having to execute the missed approach and consider other options.
The major advantage RNP procedures have over other types of approach is their tighter lateral boundaries, which allow the creation of curved pathways through mountain valleys or by using so-called radius-to-fix (RF) turns to avoid terrain or obstacles. The RNP SAAAR approach to Atlanta DeKalb-Peachtree Airport (PDK) is a good example of the benefits RNP can provide. The approach to PDK’s Runway 2R incorporates a continuous descending turn designed to avoid the tall towers that block the straight-in approach to the field. Due to the east-west flows at nearby Hartsfield-Jackson International, a straight-in ILS or WAAS LPV approach to this runway would be hard to implement, even if the obstacles southwest of the airport were removed.
While WAAS LPV approaches are excellent alternatives to traditional ILS procedures, they have performance limitations that prevent them from incorporating curved paths. The FAA’s RNP program is aimed more at FMS-equipped operators who can fly curved RF legs. Honeywell’s corporate flight department at Morristown Municipal Airport in New Jersey became one of the first in the country to obtain approval for RNP SAAAR operations, gaining certification for its own Gulfstream G450 and G550. Since then Honeywell has been named an RNP SAAAR designated consultant, giving the company the authority to assist other operators and providing the opportunity to create the Go Direct branded service package.
The service offering is split into three categories, the first dealing with aircraft equipage, the second with the operational approval documentation that must be submitted to the FAA and the third with database validation and ongoing RNP SAAAR recordkeeping. Installing RNP-compliant avionics and uploading the latest FMS software adds to the cost of RNP compliance, as does the database validation and monthly record-keeping program. Additional simulator training is required as well, and all of the large training providers are offering RNP-specific courses. Although the process takes around three months to complete and requires additional pilot training, many operators can upgrade to RNP simply by loading new FMS software, according to Honeywell.
“RNP takes advantage of a lot of technology that has evolved over the last 30 years, such as inertial reference systems, GPS and FMS, but it sets a new performance standard here and now,” said Honeywell’s Cundiff. “We want to help get more operators flying in the RNP environment because the capability is so amazing.”
NBAA has provided the FAA with a list of RNP SAAAR procedures that would benefit business aircraft operators. Several of those approaches are in the process of being created now. Honeywell and Jeppesen worked with the FAA to create an RNP SAAAR approach to Morristown’s Runway 5, primarily as an exercise aimed at showing what is involved in developing such procedures at an airport used predominantly by business aircraft operators. Honeywell never gained final approval for the approach, partly because the three major New York-area airports are undergoing a major traffic-flow redesign that may or may not fit with the RNP procedure as designed. After the New York airspace redesign is implemented, Honeywell might go back and amend the Morristown RNP procedure as needed to gain approval for it, Cundiff said.
Most newer business jets equipped with Honeywell flight management systems can be upgraded for RNP through a software upload to version 6.1 (for NZ-series FMS equipment) or 7.1 (for Primus Epic-equipped aircraft), both of which will be available later this year. Older airplanes might require a new FMS and perhaps other equipment such as an inertial sensor and upgraded GPS receiver. A WAAS GPS receiver is not specifically required, but having one eliminates the need to do a pre-departure RAIM (receiver autonomous integrity monitoring) check. For an FMS to meet the requirements of RNP, it needs to be able to fly a curved path. Also, when the pilot presses the go-around button, the FMS should be able to remain in the nav mode. This latter capability in Honeywell’s FMZ-2000 and Primus Epic platforms is being addressed through software updates, Cundiff said.
Five Gulfstream operators so far have tapped Honeywell’s expertise for the RNP SAAAR approval process. An operator who is interested in gaining operational approval for RNP can should contact Honeywell to determine how best to meet the FAA’s requirements. Honeywell representatives assist the operator with the RNP application as part of a “turnkey” service package costing $90,000.
RNP for Everybody Else

Avidyne founder Dan Schwinn is on a mission to bring RNP capabilities to the general aviation masses by proving that an FMS designed for piston airplanes, turboprops and light jets can do everything a system installed in a multimillion-dollar business jet can do. “Our objective is to make RNP totally mainstream,” Schwinn said. “It couldn’t be further from that now with this SAAAR business–in other words, how to avoid having anybody be able to use RNP for anything.”
Avidyne has designed a clean-sheet flight management system called the FMS 900w that incorporates a number of features and operating logic that until now had been present only at the higher end of the FMS spectrum. This includes RNP legs, route types and transitions presented graphically on the displays. The FMS 900w technically can be used to fly an RNP SAAAR procedure, but it lacks the approval to do so because of the absence of backup nav capability and other FAA-imposed limitations, Schwinn said.

If the station is occupied full-time by career firefighters, it will contain living quarters and work areas, where they wait until a callout comes through. In some small fire departments, the only alarm may be a telephone for receiving calls.
Many fire stations were built with the living quarters above the garage. This arrangement is common for fire stations built in a crowded city. The Maze of Galious: Knightmare II (魔城伝説II ガリウスの迷宮, Majō Densetsu Tsū: Gariusu no Meikyū, lit. ’Demon Castle Legend II: The Maze of Galious’), is the sequel to Konami’s MSX game Knightmare: Majou Densetsu. While the original game was an overhead, vertical scrolling shooter, The Maze of Galious is a side-view, flick-screen platform game.

The player controls Popolon and Aphrodite, entering the evil priest Galious’ castle to free their yet-to-be-born son Pampas from the priest’s evil clutches. Being able to control Popolon and Aphrodite means the player can switch between two characters that have slightly different abilities. For example, Popolon can push stones and open heavy doors. On the other hand, Aphrodite survives longer under water and she can shoot more projectiles. Should either character die, the other can visit a shrine and pay for resurrection. Unlike typical platform games, both characters can survive some damage as they have hit point bars.Gameplay[edit]
The game has several types of enemies, each with strengths and weaknesses. Some monsters are immune to frontal attacks, some are more vulnerable to fire and so on. Ten different bosses are to be fought too. Defeating a boss will give the player a key that is used to unlock doors to other boss areas. In-game saving is provided by giving player an encoded password.
The Maze of Galious offers extra content if The Game Master, Knightmare or Q*bert are inserted in the second cartridge slot available on some MSX machines.Development[edit]
A Family Computer version of Majō Densetsu II was released exclusively in Japan a few months after the MSX release. The Famicom version, titled Majō Densetsu II: Daima Shikyō Gariusu (魔城伝説II 大魔司教ガリウス, Demon Castle Legend II: Great Demon Bishop Galious), is a completely redesigned version of the game.Legacy[edit]
La-Mulana is a homage to MSX games in general and The Maze of Galious especially,[2] and borrows many elements from the game.
